Summary

This study analyses the soft law standards and regulations of international human rights law regarding hate speeches towards migrants, as well as the main case law in this regard from the Strasbourg Court. It applies these developments to the García Albiol case, and to the most recent case of Vox as a gauge of the situation in Spain with regards to such advances. In this latter case, it looks at the subsequent speeches of this political party, emphasising the dangers that online discourse and fake news has on the dignity of migrants. It concludes that work is needed in Spain to integrate international standards into national case law, and that inciting discrimination brings with it a very real risk of migrant rights being affected.
